Litigation involving investment funds has developed exponentially across the globe since 2008. Whether as a result of the fraud perpetrated by Madoff, the failings of fund directors (such as Weavering) or the overall economic meltdown, investors have found themselves holding shares that may variously be gated, suspended or sometimes worthless. Whilst much of this litigation has taken place onshore (primarily in the United States), the offshore world has been at the forefront. Private equity backed companies have done much to justify the industry’s approach to continuing market turbulence. By demonstrating a level of flexibility and responsiveness not shown by listed corporates these companies are their private equity sponsors should feel cautiously confident when looking to their futures. Deal flow seems to be increasing with many transactions deploying novel structuring and increased levels of equity. Raising debt for new deals, however, remains stubbornly difficult.
